Audrie Pott, a young woman with a promising life ahead of her, was brutally raped at a high school party while in a defenseless state. The three assailants took pictures of the assault in progress and shared those pictures in an attempt to shame and bully Audrie at school. Just 8 days after the pictures emerged, Audrie took her own life. Since this time, the perpetrators have admitted their crimes, their identities were concealed and a criminal sentence was imposed of only 30 and 45 days of incarceration due to their juvenile status.
SB 838 would accomplish the following:
– If a juvenile is convicted of a sex crime, when the victim is unconscious they would receive a minimum sentence of 2 years incarceration in a juvenile facility
– Juvenile sex crime court proceeding would be open to the public, with names able to be published in the media. This decision rests with the victim, should they want the perpetrators identity to be public.
– If a juvenile is convicted of a sex crime, and also took pictures of the crime and shared them, then this would be an enhancement to the crime, resulting in an additional sentence of up to one year, plus additional fines of up to $10,000.Sign HERE
